Terms of Service

These Terms of Service (the "Terms") govern your access to and use of the Kerf website (kerf.fyi), the Kerf application, and related services (together, "Kerf"), provided by Smoothgrain Studios LLC, an Oregon limited liability company ("SmoothGrain", "we", "us", "our"). By downloading, installing, or using Kerf, or by purchasing a plan, you agree to these Terms. If you do not agree, do not use Kerf.
1. The software and your license
Kerf is a desktop editor for visually editing static websites. Subject to these Terms and your active plan, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use Kerf on devices you own or control. Kerf offers a free tier and a paid "Pro" tier; some features require an active Pro plan.
You agree not to:
- copy, resell, sublicense, rent, or redistribute Kerf;
- reverse engineer, decompile, or disassemble the software, except to the extent that restriction is prohibited by applicable law;
- circumvent licensing, entitlement, or activation mechanisms; or
- use Kerf unlawfully or in violation of these Terms.
2. Accounts
Some features require a SmoothGrain account. You are responsible for activity under your account and for keeping your sign-in credentials secure. Your Pro entitlement is tied to your account, not to a specific device.
3. Plans, billing, and cancellation
Kerf Pro is available as a subscription (billed monthly or annually) and may be offered as a one-time purchase. Subscriptions auto-renew: unless you cancel, your subscription renews automatically at the end of each billing period and the payment method on file is charged the then-current price for that period. A one-time purchase is not recurring.
You can cancel a subscription at any time; your Pro access continues until the end of the current paid period, and you will not be charged again after cancellation. Prices may change, and we will give reasonable advance notice before a change applies to your next renewal. See our Refund and Cancellation Policy for refunds and how to cancel.
4. Payments and merchant of record
Our order process and payments are handled by our merchant of record, Paddle.com Market Limited and its affiliates ("Paddle"). When you buy Kerf Pro, Paddle is the seller and merchant of record for that transaction: Paddle processes your payment, handles billing and invoicing, and collects and remits applicable sales tax and VAT. Your purchase is therefore also subject to Paddle's Buyer Terms. SmoothGrain does not receive or store your full payment-card details.
5. Refunds
We offer a money-back guarantee described in our Refund and Cancellation Policy. Approved refunds are processed through Paddle to your original payment method.
6. Your content
Kerf edits files on your own machine. You retain all rights to the websites, code, and content you create or edit with Kerf. We do not claim ownership of your content, and the files you edit are not transmitted to us in the course of normal editing.
7. Intellectual property
Kerf, including its software, design, branding, and content, is owned by SmoothGrain and its licensors and is protected by intellectual-property laws. These Terms grant you a license to use Kerf; they do not transfer ownership to you. "Kerf" and "SmoothGrain" are our marks.
8. Disclaimers
Kerf is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that Kerf will be uninterrupted, error-free, or compatible with every project or future operating-system update. You are responsible for keeping backups of your work.
9. Limitation of liability
To the maximum extent permitted by law, SmoothGrain will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or revenue, arising out of or relating to your use of Kerf. To the maximum extent permitted by law, our total liability for any claim relating to Kerf will not exceed the amount you paid for Kerf in the twelve months before the event giving rise to the claim.
10. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above, and material changes take effect on posting (or as otherwise required by law). Your continued use of Kerf after changes take effect constitutes acceptance.
11. Governing law
These Terms are governed by the laws of the State of Oregon, USA, without regard to its conflict-of-laws rules. Nothing in these Terms limits any non-waivable statutory rights you may have as a consumer in your country of residence.
